FIR does not mention the name of any suspect or accused

The cyber crime police registered a case of telephone tapping on Monday charging unknown persons under the IT Act and the Telegraph Act.

Kuldeep Kumar R. Jain, deputy commissioner of police (crime), is the complainant in the case, but the FIR has not mentioned the name of any suspect or accused.

Based on the complaint, an FIR was filed charging unknown persons under Section 26 of the Indian Telegraph Act (divulges the purport of any telegraphic signal to any person not entitled to become acquainted with the same) and Section 72 of the Information Technology Act (having secured access to any electronic record, correspondence, information, document or other material breaching confidentiality of privacy).

A senior police officer said that it is not mandatory to mention the name of a suspect or accused as the details could be added later based on the outcome of the investigation.

“It also depends on the nature of the complaint and the discretion of the Investigating Officer to mention or withhold the suspect’s name until completion of the investigation,” he said. “Since it is still unclear about the source of the leak and the officials involved, the suspect or the accused column has not been filled.”

It may be recalled that based on the probe ordered by Police Commissioner Bhaskar Rao, Joint Commissioner of Police (crime) Sandeep Patil had probed the matter and submitted an interim report to the Director General and Inspector General of Police a few days ago.

The case has been handed over to the CBI.
