Hassan Deputy Commissioner Rohini Sindhuri Dasari on Friday moved the High Court of Karnataka challenging the order of the Central Administrative Tribunal (CAT), which had asked her to give representation to the Chief Secretary against transferring from the post.
It has been contended in the petition that she has been subjected to repeated, unscheduled and premature transfers contrary to the provisions of the Indian Administrative Services (Cadre) Amendment Rules, 2014, which were framed on the directions given by the apex court.
Saying that cadre posts of IAS have a fixed tenure of two years as per the rules, it has been alleged in the petition that attempts to transfer her as Hassan Deputy Commissioner was made as she had “cracked down on mining mafia and such action had enraged the local politicians who carried a tirade against her to the Chief Minister, who, succumbing to the political pressure and for the aggrandizement of the party in power, directed such a transfer ...”
Many spared from transfer
It has been pointed out in the petition that many IAS officers, who were staying long in a particular post, were spared from being transferred.
She had claimed in the petition that CAT, which heard arguments on behalf of her as well as the State government, did not give any judicial finding but disposed of her plea merely asking her to submit a representation to the Chief Secretary despite making a reference in the order that the “transfer order lacks proper application of mind ...” Ms. Dasari, who assumed charge as Hassan Deputy Commissioner in July 2017, was transferred on January 22, 2018 but it was put on hold till March 5 with the intervention of Election Commission, and her plea against this transfer closed before the tribunal.
On March 7, the government again transferred her but she was retained in the same post temporarily till the disposal of her fresh plea before the tribunal, which, on March 21, allowed her continuation in the post till March 26, before which she has to give representation to the Chief Secretary.
